AN ACT concerning schools; relating to healthy food choices in vending
machines.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) Beginning with the 2005-2006 school year, every
school district shall require that all of the food product offerings in vending
machines accessible to students on the premises of an elementary or
middle school be healthy food alternatives including, but not limited to,
such items as bottled water, milk, 100% fruit juices, dairy products, fruit
or vegetables.
(b) Beginning with the 2005-2006 school year, every school district
shall require that 50% of the overall food product offerings in vending
machines accessible to students on the premises of a high school be
healthy food alternatives including, but not limited to, such items as bottled
water, milk, 100% fruit juices, dairy products, fruit or vegetables.
(c) Beginning with the 2005-2006 school year, elementary, middle
school and high school teachers are prohibited from using candy as a
reward or incentive.
(d) Healthy food alternatives shall not include foods of minimal nutritional
value as defined by the United States department of agriculture
under the national school lunch program.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
